针对当前代建管理取费现状及其存在问题,提出从项目所有权配置以及风险分担机制的视角对代建取费进行研究。阐述了项目所有权配置下的分险分担机制,并分析了基于风险分担的代建费与建设单位管理费的异同之处,给出了项目所有权及风险分担约束下的代建费的构成及相应取费公式。借鉴PMC合同及FIDIC白皮书中的取费方案,综合上述研究结果对我国当前代建合同中的取费机制提出了改进意见。

In consideration of the charging status of the construction-agent system and the problems thereinto at present,it proposes to study the charging mechanism of the system from the viewpoint of the project ownership allocation and risk-sharing mechanism.On the basis of this,the risk-sharing mechanism under the project ownership allocation is expatiated and both the similarities and the differences between the construction-agent charge and the management fee of owner are analyzed,and then the composition of the construction-agent charge under the restriction of the project ownership and the risk-sharing is presented herein with the relevant charging formula.By taking the charging schemes in PMC(Project Management Consultant)contract and FIDIC white book as the reference,some viewpoints on the modification of the charging mechanism for the construction contract made under the construction-agent system at present are put forward based on the summarization of the study mentioned herein above.
